How to obtain the trademark

Every designer, whether he/she was born, is working or was trained in Eindhoven, can in fact obtain the Eindhoven Design Trademark for the products designed by him/her. So, Eindhoven designers who have been working abroad for a long time can most certainly make claims on the Trademark as well. There are no further criteria attached to the application submitting.
All product designs should be submitted digitally (CD, DVD). (See: application form) and sent to the Office of the Foundation in Eindhoven.

Prior to the assessment of the design, the application fee should be paid. The sender will hear within one month if his/her design has been received in good order and when the design will be assessed. If the Assessment and Advisory Body of the Foundation advises positively on quality, reproduction feasibility and origin, the Board of the Foundation is free to grant the Trademark to the sender. The advice by the Assessment and Advisory Body to the Board of the Foundation is not made public.

If the Trademark is granted, it will always be for one year. Before the start of each calendar year the “retention fee” should be paid by the trademark holder, after which the Trademark may be used for another 12 months. It is also possible to buy out the “retention fee” in one amount for the total production-age of the product. This amount then equals 10 annual fees.

When the Trademark has been granted, the Foundation will consult the Trademark holder about the way he/she wishes to use the Trademark. For the use of the registered Trademark logo, the Foundation has a company logo guide. By mutual agreement, after written consent, it is possible to deviate from it.
Both the Foundation and the new Trademark holder can seek publicity about trying to obtain the Trademark in the way they like and through their own channels. For that purpose they are also allowed to use the logo of “Eindhoven Design”.
The granting of the Trademark “Eindhoven Design” is accompanied by a dated Document in which the right to use the Trademark is described. In exceptional cases the Foundation can grant the Trademark to a product designed in Eindhoven on its own initiative. In those cases products are involved that, without any doubt, are of an internationally acclaimed level and already enjoy an apparent recognition as well..
